Terms and Conditions — BioWaste Driver App

These Terms and Conditions ("Terms") govern your use of the BioWaste Driver mobile application (the "App"), operated by BioWaste LLC ("BioWaste," "we," "us," or "our"), Tullahoma, Tennessee. By signing in to or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Authorized Use

The App is provided exclusively to current employees and authorized contractors of BioWaste LLC for the performance of their job duties. A company-issued account is required. The App is not available to the general public, and any use by unauthorized persons is prohibited.

Your use of the App is also subject to your employment agreement or contractor agreement and applicable company policies. If these Terms conflict with your employment or contractor agreement, that agreement controls.

2. Accounts and Credentials

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not share your account or allow anyone else to use the App under your identity.
  • Notify your supervisor or dispatcher immediately if you suspect unauthorized access to your account.
  • We may suspend or deactivate accounts at any time, including upon termination of employment or engagement.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you control, solely for performing your work duties for BioWaste. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except where such restrictions are prohibited by law.

4. Safe Use — Do Not Use While Driving

Do not interact with the App while operating a vehicle. You must comply with all applicable traffic laws, including hands-free and distracted-driving laws. Complete all App interactions — reviewing stops, capturing signatures, taking photos, entering manifest data — only while the vehicle is safely parked. Navigation features, if used, must be configured before driving and operated hands-free. You are solely responsible for safe vehicle operation at all times.

5. Location Tracking

The App collects precise GPS location data during active work sessions as described in our Privacy Policy. Location tracking during work hours is a condition of using the App and performing route duties. By using the App, you consent to this collection as described in the Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the App for any purpose other than performing your assigned duties
  • Falsify service records, manifests, signatures, timestamps, or photos
  • Capture photos or data unrelated to the documented service, including images of patients, medical records, or other protected health information
  • Attempt to access data, routes, or accounts not assigned to you
  • Interfere with or disrupt the App, its servers, or its security features
  • Use the App in violation of any applicable law or regulation

Falsification of waste manifests or chain-of-custody records may violate federal and state law and will result in disciplinary action up to and including termination, and may be referred to authorities.

7. Company Data and Confidentiality

All data created, captured, or stored through the App — including routes, customer information, manifests, signatures, and photos — is the property of BioWaste LLC and constitutes confidential business information. Customer facility information may also be subject to confidentiality obligations under our customer contracts. You may not disclose, export, or retain such data outside of authorized company systems, during or after your employment or engagement.

8. Intellectual Property

The App, including its software, design, logos, and content, is owned by BioWaste LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the App.

9. Updates and Availability

We may update, modify, or discontinue the App or any feature at any time. Updates may be required for continued use. The App depends on network connectivity and third-party services; we do not guarantee uninterrupted availability.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROUTING AND NAVIGATION INFORMATION MAY BE INACCURATE OR INCOMPLETE; YOU REMAIN RESPONSIBLE FOR SAFE AND LAWFUL DRIVING DECISIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOWASTE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. NOTHING IN THESE TERMS LIMITS RIGHTS YOU MAY HAVE UNDER APPLICABLE EMPLOYMENT OR WORKERS' COMPENSATION LAW.

12. Termination

Your right to use the App ends automatically when your employment or engagement with BioWaste ends, or earlier if we suspend or revoke your access. Upon termination, you must stop using the App and delete it from your personal devices. Sections 7, 8, 10, 11, and 14 survive termination.

13. App Store Terms

13.1 Google Play

Your download of the App from Google Play is also subject to the Google Play Terms of Service.

13.2 Apple App Store

If you download the App from the Apple App Store, the following applies: these Terms are between you and BioWaste LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims of legal or regulatory non-compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Tennessee, except as otherwise required by your employment or contractor agreement.

15. Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms at this URL and update the "Last Updated" date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
